GENERAL TERMS & CONDITIONS
SMARTER DRIVER TERMS & CONDITIONS 3.2
DEFINITIONS
1. "SD" refers to Smarter Driver Driving School.
2. "Instructor" refers to the individual trainer working either directly for, or on behalf of Smarter Driver.
3. "Customer" refers to the payee & the pupil.
4. "Purchaser" refers to the person buying driving lessons either for themselves or a third party.
5. "Special offers"refers to the offers shown on the Courses and Prices page.
7. "Training vehicle" refers to the vehicle in which driving tuition is carried out in.
1. GENERAL CONDUCT
Your instructor will be behave in a courteous manner, they will be polite and punctual. Your instructor will behave in a professional and non-judgemental manner at all times.
2. THE TRAINING VEHICLE
The training vehicle will be fully insured for the training provided. The training vehicle will be fitted with dual-controls. The training vehicle will be maintained to the highest standard possible. The training vehicle will also be kept in a clean and tidy condition, unless weather conditions have allowed otherwise. The training vehicle will remain 100% smoke free at all times.
2. QUALIFICATIONS
Your instructor will be a fully qualified DVSA APPROVED DRIVING INSTRUCTOR. Your instructor will also be officially registered to do PASS PLUS courses.
3. LEARNING RESOURCES
Theory test pro is a third party software used by SD, the instructor & the customer. Theory test pro is a chargeable service provided to our students. E-LEARNING is a chargeable service provided directly online by SD through our website.
SMARTER WORKSHOPS is also a chargeable service provided by SD. SD has the right to cease providing the following services Theory test pro, E-LEARNING and SMARTER WORKSHOPS if fees are not paid. Continued access to the services mentioned in this section are provided to registered students only. The services may be ceased at any time at the discretion of SD. If access is revoked to these services then you will not be entitled to a refund for any used allowance.
There will be reasonable downtime for these service at times due updates.
4. REQUIREMENTS FOR DRIVING
By law the student is required to hold a current provisional or full, valid driving licence. The student must produce this licence either prior to, or on the first training session. The student must also be able to read a vehicle number plate at a distance of 20.5 metres with prescribed visual aids, such as contact lenses of glasses, if normally worn. If the student needs glasses or contact lenses in order to do this, then they must be worn for every lesson.
The student must provide a license check code to SD/ the instructor prior to the training session commencing. This is for insurance purposes.
5. SAFETY
The student must wear suitable footwear and clothing for every lesson.
The student should behave in a sensible manner throughout the training session and give their undivided attention. If the student is distracted by anything during the lesson then this should be mentioned to the instructor. If you feel uncomfortable or uneasy about anything during training session you should also tell the instructor.
-Should there be an emergency situation the student MUST follow the instructors instructions and allow them to take control of the training vehicle in order to keep everyone safe. Taking control of the training vehicle may be by using the dual control brake or/ and brake or guiding the steering wheel. If the instructor does need to intervene then this will be discussed with you from a learning point.
-Your instructor will endeavour to give any instructions in good time and any physical actions needed will be in a calm manner.
-The instructor will not use any improper language, no improper behaviour or physical contact.
-The student must take note of medication being used which may affect your driving ability and must advise your instructor and SD before attending a training session.
-Should it be apparent the student is unable to concentrate due to illness, tiredness or due to an emotional state of mind then the instructor and SD have the right to terminate the training session earlier than planned, or to seek agreement to choose a learning task fit for the circumstances.
-Mobile phones MUST be switched to silent or turned off while training is taking place. Mobile phones cause unnecessary distraction during training when 100% focus needs to be given to the task of learning at hand. It is illegal to use a handheld device while driving, leading to 6 points on your license and a £200 fine. If you have passed your test within 2 years of the offence you will lose your license.

6. DRIVING UNDER THE INFLUENCE
SD and your instructor reserve the right to cancel and training sessions if the student is suspected of being under the influence of drugs (prescribed or not), legal highs, alcohol. The student will forfeit the fees for the training session in in question.
7. CANCELLATIONS
The student MUST give a MINIMUM OF TWO FULL DAYS notice to the instructor if a training session/ sessions needs to be cancelled or rescheduled.
If the cancellation is received within one full day prior to the date of the training session then a full charge for the full training session will be applied with no exceptions. If the cancellation is received within two full days, but not later than one full day only half of the total cost for the cancelled training session will be applied.
Late cancellations within two full working days does not allow adequate time to arrange a replacement student for the cancelled slot. However should SD/ the instructor be able to fill the cancelled slot with another student then the charge will not be applied.
If the student cancels more than 3 occasions within a 10 week period then this WILL result in all training sessions being withdrawn in order to make availability to other students who need training. In this scenario a full refund of any remaining balance will be refunded via a pro-rata method.
The instructor and SD reserve the right to postpone lessons at their own discretion should they consider the weather or road conditions to be unsuitable or dangerous.
The instructor/ & SD also reserves the right to cancel training sessions should there be a mechanical issue with the a vehicle and if an alternative vehicle cannot be sourced. In the event of SD/ the instructor cancelling any training sessions within 2 full days due to bad weather, poor road conditions, mechanical issues, last minute test bookings, or any reason out of our reasonable control the intsructor/ SD will not be liable at any point to offer additional credit of training hours as compensation. Lessons cancelled by SD/ the instructor for the reasons mentioned in this paragraph will not be charged.
SD and the instructor cannot be held responsible for any costs incurred as a result of us cancelling training sessions for whatever reason.
8. PUNCTUALITY
The student is to be punctual for all training sessions. The student is responsible for recording their own appointment schedule, they should also request an appointment record card if they wish to do this in order to help avoid mistakes happening.
The instructor will wait up to 15 minutes maximum for the student before the training session being abandoned and the full fee for the training session being forfeited.
A reciprocal waiting time should be allowed for the instructor, should there be delays due to unforeseen circumstances. Any lesson time lost as a result of the instructor being late will either be added to the end of the training session, or as soon as reasonably possible. This is also the responsibility of the student to record this on the SD.
An appointment reminder is usually sent out on a weekly basis to confirm lessons for the following week. This is purely out of courtesy, however if a reminder hasn't been received, this does not mean your training session has been cancelled. SD/ the instructor reserve the right to cease sending appointment reminders without any notice.
9. PAYMENTS

You are required to make payment for all training in advance of the training session. 10 hour block bookings must be input into the diary immediately after receiving payment. 2 hourly pay as you go lessons MUST also be paid and booked in the diary immediately without exception.

All bookings MUST be paid at the time of booking to confirm the booking date and time, otherwise the appointment runs risk of being given to another student. If payment hasn't been received by SD or the instructor within 24 hours of making the booking then the booking will be null and offered to other students.

When the booking is made with less than 24 hours notice prior to the training session commencing: PAYMENT IS DUE IMMEDIATELY. In this scenario if the payment hasn't been received before the training session commences then SD and the instructor will reserve the right not to attend the appointment as it will be deemed as a non attended cancellation. If this scenario is repeated 3 times then SD or/ and the instructor will cease training for the student.

FOR INTENSIVE COURSE BOOKINGS ONLY: The deposit or any subsequent training fees paid are not refundable in the event you decide to cancel the training once the booking has been accepted by me and placed in my diary. At this point a binding agreement is made between yourself and me. This does not in any way affect your statutory rights to be provided with the goods and services you have bought. A full refund will be given if I can not satisfy any special requirements noted and as shown under the "special requirements & additional notes" section of the booking form.
10. THE DRIVING TEST & DRIVING TEST BOOKINGS
Driving tests can either be booked by SD, your instructor or by the student.
Driving test bookings always take priority over any training sessions. The student is expected to be prepared for this scenario and vice-versa should they have a Driving test booked. The student will be notified immediately if this is the case.
The instructor and SD must be notified of any DRIVING TEST BOOKINGS, otherwise we cannot guarantee use of a training vehicle for the Driving test or any lessons just prior to it. Any changes to DRIVING TEST BOOKINGS should be communicated with the instructor & and SD.
SD and the instructor reserve the right to refuse use of the training vehicle for the DRIVING TEST BOOKING in the interests of safety if we deem the student's driving to be potentially or actually dangerous, or if the behaviour of the student is deemed to be unacceptable.
Three clear working days are needed by the DVSA in order to cancel a DRIVING TEST BOOKING in order to receive a full refund, or to reschedule a DRIVING TEST BOOKING. SD and the instructor cannot be held liable should a refusal of training vehicle or cancellation of the DRIVING TEST BOOKING occur within less than three clear working days of the DRIVING TEST BOOKING.
11. COMPLAINTS
In the event of a complaint please contact SD directly and we will endeavour to deal with the complaint promptly.
12. YOUR STATUTORY RIGHTS
Nothing in these terms and conditions will reduce your statutory rights relating to faulty goods or services provided. SD has a statutory obligation to provide you with the goods and services for the purpose for which they were bought and described.
